Terms of Service

1. About these Terms

1.1 These Terms are between you and Eugene Koh Vee Jin, trading as "Garaj" ("Garaj", "we", "us" or "our").

1.2 By downloading, accessing, registering for or using Garaj, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use Garaj.

1.3 These Terms should be read together with the Garaj Privacy Notice, which explains how Garaj processes personal data.

1.4 BeBo Labs PLT, a limited liability partnership, is being registered in Malaysia to operate Garaj. When it is registered, Eugene Koh Vee Jin will transfer the App and these Terms to BeBo Labs PLT under clause 25.13, and references to "Garaj", "we", "us" and "our" will then mean BeBo Labs PLT. We will tell you through the App or by email when this happens.

2. About Garaj

2.1 Garaj is a personal record-keeping and maintenance reminder tool designed to help vehicle owners organise and manage information relating to their vehicles. Depending on the features available to you, Garaj may provide:

2.1.1 Vehicle profiles, service records, and road tax and insurance expiry tracking.

2.1.2 Maintenance reminders and estimated service intervals or replacement schedules for common wear-and-tear components.

2.1.3 Manufacturer-recommended maintenance schedules and reference information based on your vehicle's make, model, year and other relevant details.

2.1.4 Custom vehicle records and owner-managed tracking for parts, modifications and maintenance activities.

2.1.5 Features that allow users to record and monitor vehicle setup information, including suspension, alignment and handling configurations and saved setups, primarily for track or performance-oriented vehicles. Some of these features may require a paid subscription. They are supplementary and are not required for core vehicle maintenance tracking.

2.1.6 Vehicle-related recommendations, insights and other features that may be introduced from time to time.

2.2 References in these Terms to a "vehicle" include any type of vehicle that the App supports from time to time, which currently includes passenger cars and motorcycles. Garaj may extend the App to support other vehicle types in the future. Where a feature, data field, estimate or recommendation is designed for a particular vehicle type, it may not be available, or may operate differently, for another vehicle type until Garaj adapts it.

2.3 Certain features and functionalities may vary depending on your vehicle type, geographical location, user profile, subscription tier and product availability.

2.4 Garaj is intended to assist users in managing vehicle-related information and does not replace professional mechanical advice, vehicle inspections, manufacturer recommendations or legal obligations relating to vehicle ownership and operation.

3. User Account

3.1 You may be required to create an account to access certain features of Garaj.

3.2 You agree to:

3.2.1 Provide accurate and complete information;

3.2.2 Keep your login credentials secure;

3.2.3 Notify us immediately of any unauthorised use of your account; and

3.2.4 Be responsible for all activities conducted through your account.

3.3 You must be at least 18 years old to create an account or use Garaj. By creating an account you confirm that you are 18 or older. We ask for your date of birth when you create your account to help us check this.

4. User Accounts, Content and Third-Party Services

4.1 You are responsible for maintaining the confidentiality and security of your account credentials and for all activities conducted through your account. You must promptly notify Garaj if you become aware of any unauthorised access to or use of your account.

4.2 You retain ownership of any information, records, photographs or other content you upload to the App ("User Content"). By uploading such content, you grant Garaj a non-exclusive, royalty-free licence to use, process, store and display such content solely for the purpose of operating, maintaining and improving the App and its services.

4.3 You represent that you have the necessary rights, permissions and authority to upload or provide User Content and that doing so does not knowingly violate another person's privacy, intellectual property or other rights. You must not upload malicious code, unlawful material, content that infringes another person's rights, or information that you are not authorised to provide. Garaj may remove, restrict or disable access to User Content where reasonably necessary to comply with law, protect users or the App, or enforce these Terms.

4.4 The App may contain links to, integrate with, or make available products, services, content or information provided by third parties, including vehicle manufacturers, workshops, insurers, payment providers and other service providers. Such third-party products and services are subject to the terms and policies of the relevant third party. Garaj is not responsible for the availability, accuracy, performance or content of any third-party products or services, and your dealings with such third parties are solely between you and the relevant third party.

5. Acceptable Use

5.1 You must not use Garaj to:

5.1.1 impersonate another person or misrepresent your identity or authority;

5.1.2 commit fraud or other unlawful activity;

5.1.3 gain unauthorised access to accounts, systems, databases or services;

5.1.4 introduce malware, malicious code or harmful content;

5.1.5 scrape, harvest, copy or systematically extract Garaj data except through functionality expressly provided by Garaj;

5.1.6 interfere with the security, integrity or operation of the App;

5.1.7 reverse engineer or attempt to discover source code except to the extent such restriction is prohibited by applicable law;

5.1.8 infringe another person's intellectual property, privacy or other rights; or

5.1.9 use Garaj in a way that could reasonably damage the App, its users or third-party systems.

6. Shared Vehicles, Family and Fleet Access

6.1 If Garaj permits you to invite another person to view, add to, edit or otherwise access a vehicle or account, you are responsible for ensuring that you have authority to grant that access. You must not provide access to a vehicle, service record, document or other personal information belonging to another person without appropriate authority.

6.2 Permissions may vary by feature. Garaj may restrict, revoke or modify shared access where reasonably necessary for security, legal or operational reasons.

7. Vehicle Sale or Transfer

7.1 Garaj does not automatically transfer ownership of a vehicle record or the personal data associated with it when a vehicle is sold or transferred. Where Garaj provides a transfer function, the transfer must be authorised by the relevant account holder and may be subject to separate verification and transfer rules.

7.2 Garaj may offer a paid vehicle history report that an account holder can generate and share with a prospective buyer or other third party of the account holder's own choosing. The report may include service and maintenance history, mileage records and an assessment of mileage plausibility and service-interval adherence, receipts and workshop information, and other information the account holder has recorded in the App. Certain fields, such as recorded cost information, may be hidden by the account holder before sharing; mileage plausibility and service-interval adherence indicators are not hideable. Generating and sharing a report is entirely at the account holder's own initiative and discretion, and Garaj is not responsible for how a shared report is used, or for any decision made by a recipient in reliance on it.

8. Vehicle Information and Recommendations

8.1 Garaj is a personal vehicle record-keeping and maintenance reminder tool. Garaj is not a mechanic, workshop, vehicle manufacturer, engineer, vehicle inspector, safety certification body, insurer or emergency roadside assistance provider.

8.2 Information, recommendations, reminders, projections and other content made available through Garaj are provided for general informational and convenience purposes only and are not intended to replace professional automotive inspection, diagnosis, repair, maintenance or safety advice.

8.3 You acknowledge and agree that:

8.3.1 Any maintenance schedules, service reminders, replacement intervals, due dates, mileage estimates, component status indicators or recommendations displayed through Garaj are estimates and projections only and should not be treated as definitive, guaranteed or tailored to the specific condition of your vehicle.

8.3.2 Such projections may be generated based on a combination of manufacturer-published service intervals (where available), information provided by you, estimated vehicle usage patterns, mileage records and other data sources.

8.3.3 Manufacturer service interval and maintenance information presented through Garaj may be compiled or aggregated from manufacturers, authorised dealers, industry publications, specialist sources and other third-party references. Garaj does not verify such information against your vehicle's specific owner's manual, service records or actual operating condition.

8.3.4 Certain vehicle components, including tyres, shock absorbers, suspension components, brake pads and brake discs, are primarily condition-based and may not have reliable manufacturer-recommended replacement intervals. In such cases, Garaj may provide general guidance only and may not display a specific due date or mileage estimate.

8.3.5 A component, system or vehicle status shown as "Good", "Normal", "Healthy" or by any similar designation does not constitute a warranty, representation or certification that the component is free from defects, safe to operate, roadworthy or unlikely to fail.

8.3.6 Users should not rely on Garaj to determine whether a vehicle is safe, roadworthy or fit for use. Any warning lights, abnormal noises, changes in vehicle handling, fluid leaks, overheating, braking concerns or other safety-related symptoms should be promptly assessed by a qualified automotive professional.

8.3.7 Vehicle components and systems may deteriorate, malfunction or fail unexpectedly due to age, wear and tear, manufacturing defects, driving conditions, accidents, environmental factors or other causes beyond Garaj's knowledge or control.

8.3.8 You remain solely responsible for monitoring the condition, safety, maintenance and roadworthiness of your vehicle and for obtaining appropriate professional inspections, servicing, repairs and technical advice when required.

8.3.9 For some vehicles, and in particular some motorcycles, Garaj may not hold model-specific manufacturer information and may instead show general, brand-level or Garaj-guidance reminders. These are not manufacturer requirements. You should check your owner's manual or ask an authorised workshop before relying on them.

8.4 Garaj does not warrant the accuracy, completeness, reliability, suitability or timeliness of any vehicle-related information, projections or recommendations provided through the App. Any reliance on such information is at your own risk.

9. Diagnostics and DTC Information

9.1 If Garaj provides diagnostic trouble code (DTC), fault-code, diagnostic, scan-result or related information, that information is provided for general informational purposes only. A code or suggested cause does not constitute a diagnosis, safety assessment, repair instruction or confirmation of the underlying fault. Multiple faults may produce similar symptoms or codes. Users should obtain appropriate professional diagnosis and repair, particularly where a fault may affect safety or vehicle operation.

10. AI and Automated Recommendations

10.1 Garaj may use automated systems, algorithms or artificial intelligence to generate summaries, estimates, classifications, recommendations or other outputs. Such outputs may be incomplete, inaccurate, outdated or inappropriate for a particular vehicle or situation. Automated output must not be treated as professional mechanical, safety, legal, insurance or financial advice. You remain responsible for verifying important information before acting on it.

10.2 Where the App shows an answer generated by an AI feature (such as "Ask garaj"), you can report the answer if you think it is wrong, offensive or unsafe, using the report option shown with it. We review reports and use them to improve the feature, but we do not promise to respond to each report individually.

11. Notifications, Alerts and Vehicle Modifications

11.1 The App may send reminders, alerts and notifications regarding vehicle-related matters for your convenience. Failure to receive any notification does not relieve you of your responsibility to maintain your vehicle or comply with applicable legal, insurance, safety or roadworthiness requirements.

11.2 You are responsible for maintaining appropriate device settings, notification permissions, internet connectivity and contact details needed to receive communications from Garaj.

11.3 If your vehicle has been modified, tuned, fitted with aftermarket parts or used for motorsports or track activities, maintenance requirements and component life may differ from Garaj's estimates and recommendations. You remain responsible for ensuring your vehicle is properly maintained and inspected.

12. Track Day, Performance and Motorsports Features

12.1 Advanced, performance, lap, track-day, setup or motorsport-related features are intended for record-keeping and informational purposes. They do not constitute driving instruction, vehicle safety certification, roadworthiness certification or a guarantee of performance. Track and motorsport activities involve inherent risks, and you are responsible for complying with applicable venue rules, safety requirements and professional advice.

13. Manufacturers, Brands and Independence

13.1 Unless Garaj expressly states otherwise, Garaj is an independent service and is not affiliated with, endorsed by, sponsored by or authorised by any vehicle manufacturer, parts manufacturer, dealer, workshop, insurer or other third party merely because its name, logo, vehicle data or products appear in the App. Manufacturer and third-party names are used for identification, reference or service purposes only where applicable.

14. Parts, Workshops, Insurers and Other Recommendations

14.1 Garaj may display or recommend products, parts, workshops, insurers or other third-party services. A recommendation does not constitute a warranty or guarantee of compatibility, availability, price, quality, workmanship, suitability or performance. Any purchase, booking, repair, insurance or other transaction with a third party is between you and that third party unless Garaj expressly states otherwise.

14.2 Where Garaj receives a fee, commission or other commercial benefit for a recommendation, Garaj may disclose that relationship as required by applicable law.

15. Fees, Subscriptions and Payments

15.1 Certain features of the App may be offered on a paid or subscription basis. Any applicable fees, billing terms and taxes will be disclosed before purchase. Before completing a purchase, you will be shown the applicable subscription price, billing frequency, renewal terms and any applicable taxes or charges. By subscribing, you authorise the relevant payment platform to charge the applicable fees in accordance with those terms.

15.2 Unless otherwise stated, a subscription continues until cancelled. If a subscription renews automatically, the renewal terms and applicable price will be disclosed before or at the time of purchase as required by applicable law and the relevant payment platform.

15.3 You may cancel a subscription using the cancellation method made available by Garaj or the relevant payment platform. Cancellation will generally take effect at the end of the current paid subscription period and will prevent future renewal charges. Refunds will be handled in accordance with the applicable payment platform's policy, the offer terms and applicable law.

15.4 Where payment is processed through Apple App Store, Google Play or another third-party payment platform, that platform's payment, cancellation and refund rules may also apply. Garaj does not control third-party payment-platform policies.

15.5 Garaj may suspend or restrict paid features where payment fails, is reversed, or is reasonably suspected to be fraudulent. Garaj may change subscription prices for future billing periods by providing notice as required by applicable law.

15.6 Unless otherwise stated at the time of purchase, subscriptions are auto-renewing: your subscription will automatically renew for successive periods of the same duration at the then-current price unless you cancel before the end of the current period. Garaj does not operate a separate refund process for subscription fees; refund requests are handled by the payment platform through which the subscription was purchased (Apple App Store or Google Play) in accordance with that platform's own refund policy, and Garaj does not guarantee that any particular refund request will be approved.

15.7 Garaj may offer a limited free allowance (for example, one active vehicle and one driver on your account) and may require a subscription for additional vehicles, additional family drivers or certain features. If a subscription ends or lapses, vehicles and access beyond the free allowance may become read-only: your records remain viewable, but you may not be able to add or edit entries, and reminders for those vehicles may stop, until you resubscribe or retire, transfer or delete those vehicles.

16. Trials, Promotions and Credits

16.1 Free trials, promotional pricing, credits and introductory offers may be subject to additional terms displayed at the time of the offer. Unless otherwise stated, a promotional offer does not create a permanent entitlement to the promotional price.

16.2 Garaj may issue promotional, referral or redemption codes granting complimentary or discounted access to certain features or subscription tiers, on a limited, non-transferable basis and subject to any conditions stated when the code is issued. Garaj may limit, suspend, revoke or decline to honour a code where it reasonably suspects abuse, fraud, unauthorised sharing, or use outside its intended eligible group, or where a code has expired, reached its usage limit or been withdrawn.

16.3 Founding member codes. People invited to test Garaj before its public launch may receive a founding member code. Each code states which of the following it gives, and the access starts when the code is redeemed: (a) "Founding member for life": complimentary access to Garaj Pro for as long as Garaj offers Garaj Pro; or (b) "Founding member, first year": complimentary access to Garaj Pro for 12 months from the date the code is redeemed. When a first-year code ends, your account moves to the free plan unless you choose to subscribe, and clause 15.7 applies. No payment details are needed to redeem a code, and you will not be charged when it ends.

16.4 Founding member access covers the Garaj Pro features offered from time to time. It does not automatically include new add-ons that Garaj sells separately, and reasonable fair-use limits may apply to AI features. Founding member access is personal to the account that redeemed the code and cannot be transferred, sold or exchanged for money. Clause 16.2 applies to founding member codes, and if Garaj stops offering Garaj Pro or discontinues the App, clause 19 applies.

17. No Warranty

17.1 The App and all information, content, reminders, notifications, recommendations and services provided through the App are provided on an "as is" and "as available" basis.

17.2 Garaj does not guarantee that the App will be available at all times, uninterrupted, secure or error-free, or that any information, recommendation, reminder or notification provided through the App will be accurate, complete, current or suitable for your circumstances.

17.3 To the fullest extent permitted by law, your use of the App and reliance on any information provided through the App is at your own risk.

18. Intellectual Property

18.1 The App and all related content, features, software, logos, trademarks and branding are owned by or licensed to Garaj and are protected by applicable intellectual property laws.

18.2 Subject to these Terms, Garaj grants you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App for your personal and non-commercial use.

18.3 You must not copy, modify, distribute, sell, reverse engineer or otherwise exploit any part of the App without Garaj's prior written consent, except to the extent such restriction is prohibited by applicable law.

18.4 You retain ownership of any information, records, photographs or other content you upload to the App. All rights not expressly granted to you are reserved by Garaj.

19. Changes to the App, Availability and Terms

19.1 Garaj may, at any time, modify, update, enhance, suspend, restrict, discontinue or remove any part of the App, including any feature, functionality, content, service or level of availability.

19.2 While Garaj aims to make the App available at all times, we do not guarantee that the App or any feature will be available, uninterrupted, secure, error-free or accessible at any particular time. Access may be affected by maintenance, upgrades, system failures, network issues or factors beyond our control.

19.3 Garaj may amend these Terms from time to time. The updated Terms will be made available through the App or by other reasonable means and will state their effective date. Where an amendment materially affects your rights or obligations, Garaj will provide reasonable notice or obtain consent where required by applicable law. Your continued use of the App after the effective date constitutes acceptance of the updated Terms, to the extent permitted by law.

19.4 Garaj shall not be liable for any loss, damage or inconvenience arising from the modification, suspension, restriction, discontinuation, unavailability or withdrawal of any part of the App.

20. Suspension and Termination

20.1 Garaj may suspend, restrict or terminate your access to the App, with or without notice, if:

20.1.1 You breach these Terms;

20.1.2 We reasonably suspect fraudulent, unlawful, unauthorised or harmful activity;

20.1.3 We are required to do so by law, regulation or a competent authority; or

20.1.4 We discontinue the App or any part of its services.

20.2 You may stop using the App at any time. You can delete your account in the App (Profile → Delete account) or, if you cannot use the App, by following the instructions at garaj.my/delete-account.

20.3 Upon suspension or termination:

20.3.1 Your right to access and use the App will cease immediately;

20.3.2 You may lose access to records, content and information stored within the App; and

20.3.3 Any provisions of these Terms that by their nature should survive termination will continue to apply.

20.4 You are responsible for retaining copies of any vehicle records, documents, photographs or other information that you wish to keep before deleting your account or ceasing to use the App. Garaj does not currently provide a guaranteed export or download function. Deleting your account may make stored records inaccessible and may not be reversible.

20.5 Garaj may retain limited information where reasonably necessary for legal compliance, fraud prevention, security, dispute resolution, enforcement of rights, accounting or other lawful purposes. Such information will be handled in accordance with the Privacy Notice and applicable law.

20.6 Garaj shall not be liable for any loss arising from suspension, restriction or termination in accordance with these Terms.

21. Limitation of Liability

21.1 To the fullest extent permitted by law, Garaj shall not be liable for any indirect, incidental, consequential, special or punitive loss or damage arising from or in connection with the App, including your use of or inability to use the App, reliance on information or reminders, missed maintenance, servicing, recall, insurance renewal or road tax renewal, interruption or unavailability of the App, or any act or omission of a third party.

21.2 Garaj is a vehicle record-keeping and reminder tool only. You remain responsible for the maintenance, safety and roadworthiness of your vehicle.

21.3 Nothing in these Terms excludes, restricts or limits any liability, right or remedy that cannot lawfully be excluded, restricted or limited under applicable Malaysian law, including any applicable consumer rights or remedies.

22. Indemnity

22.1 You agree to indemnify and hold harmless Garaj, its affiliates, officers, employees and service providers from and against claims, losses, damages, liabilities, costs and expenses to the extent arising from:

22.1.1 Your breach of these Terms;

22.1.2 Your misuse of the App;

22.1.3 Any information or content provided by you through the App, to the extent that it gives rise to the relevant claim; or

22.1.4 Your violation of any applicable law or the rights of any third party.

22.2 This indemnity will continue to apply even after your use of the App has ended.

23. Privacy

23.1 Garaj will collect, use and store personal data in accordance with its Privacy Notice and applicable law. The Privacy Notice explains the categories of personal data collected, the purposes of processing, disclosures, retention, cross-border processing and your rights.

23.2 You should read the Privacy Notice before using the App. By using the App, you acknowledge that your personal data will be processed in accordance with the Privacy Notice and applicable law.

24. App Store and Platform Terms

24.1 If you download or access Garaj through an app store or other platform, additional terms imposed by that platform may apply to your use of the App, including terms relating to payment, subscriptions, refunds, account management and technical requirements. Those platform terms operate alongside these Terms to the extent applicable.

25. General

25.1 These Terms are governed by the laws of Malaysia. Any dispute arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Malaysia.

25.2 Garaj may suspend or restrict access to the App or any account where necessary for security, operational, legal or regulatory reasons.

25.3 Garaj will not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including system failures, network disruptions, acts of God, natural disasters, government actions or other force majeure events.

25.4 If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be read down or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

25.5 A failure or delay by Garaj to exercise any right or remedy under these Terms shall not constitute a waiver of that right or remedy.

25.6 By using the App, you consent to receive notices, updates, disclosures and other communications electronically, including through the App, email or other electronic means.

25.7 Where permitted by law, electronic records, communications, consents and acceptances shall have the same legal effect as their paper-based counterparts.

25.12 The availability of subscriptions, automatic renewals, refunds, commissions, export functionality and particular App features may depend on the applicable product configuration, payment platform and third-party arrangements. Garaj will provide users with the applicable information, pricing, renewal terms, refund process and feature availability before or at the time the relevant feature or transaction is made available. Garaj may update or discontinue any feature in accordance with these Terms and applicable law.

25.13 Garaj may assign or transfer its rights and obligations under these Terms to a successor to its business or to a related entity, including BeBo Labs PLT, on notice to you through the App or by email, provided your rights under these Terms and the Privacy Notice are not reduced. You may not assign your rights under these Terms.
